Terms and Conditions

R&D Laboratory Equipment LLC (R&D)   Work hours are between 8am and 5pm, Monday thru Friday.  Labor rate for service, repair and travel is $110 per hour (port to port). Afterhours rate is regular rate times 1.3.  The work includes 10 miles of travel time from 92071. Labor for repairs and parts are warrantied for 30 days.

Equipment/Parts Sale   Applicable on parts for repairs and sales tax (for the city in which the item is delivered) will be added to invoice.  Shipping is not included and will be added to the invoice.

Guarantee of Equipment   Warranty can be purchased at 25% of purchase price for a one year warranty.  All warranty repairs will be made with written consent by R&D. Warranty is not valid out of San Diego County.

Decontamination of Equipment   All equipment sold or purchased that previously used with contaminated or hazardous materials must be decontaminated and have a certificate of conformance within CDC/NIH/NSF guidelines.

Payment   Customer will pay the amount stated on the agreement and payment of NET 15 due fifteen days from purchase or work performed.

Effective Date   This agreement is effective when signed by customer and R&D, and the Effective date shall be the date the customer signed the agreement.

The customer must agree on the terms and conditions as set forth on this agreement which shall take precedence over and supersede all other terms and conditions including those that may accompany any purchase order, contract, subcontract or other document customer may issue in response to this agreement. Pricing is good for 60 days from date shown above.

Termination of Agreement   Either party may cancel this agreement on prior 48 hour with written notice (i.e email with a reply of conformation).  In the event of such termination, customer shall promptly pay R&D for all fees, charges, and expenses incurred of this agreement prior to the date of such termination.  This agreement shall terminate immediately if circumstances occur that make it impossible or impractical for either R&D or customer to continue conducting business.

Dispute Arbitration   If there is a dispute between the parties regarding fees charged to customer under this agreement, or any other matters that cannot be resolved between the parties, customer and R&D agree to submit the controversy to binding arbitration.  Arbitration shall be held in the city of San Diego, California, in accordance with the commercial arbitration rules then in effect of the American Arbitration Association, and judgment of the award entered shall be accepted by both parties and may be entered in any court having jurisdiction thereof.

Authority to Bind   The parties executing this agreement represent to each other that they have full authority and right to execute this agreement on behalf of their respective party and to bind such party to this agreement.

Consequential Damages   R&D shall not be liable for special, consequential, or contingent damages resulting from delay of performance or any default or defect.  Equipment bought or sold must be properly packed and accessible and the time of delivery of removal from premises.

Governing Law   This agreement and of its terms and conditions shall be governed by the laws of the State of California.

Equipment testing specifications:  All equipment will be tested to manufactures specifications, industry standards, Cal/OSHA, NSF Annex F, IEST-RP-CC standards. 

We do not perform ASHRAE testing for Fumehoods or Pressure Testing of BSC’s.

Orders
We request information from you on our order form. To buy from us, you must provide contact information (like name and shipping address) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fill your orders. If we have trouble processing an order, we'll use this information to contact you.

We use "cookies" on this site. A cookie is a piece of data stored on a site visitor's hard drive to help us improve your access to our site and identify repeat visitors to our site. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information.  The computers/servers in which we store personally identifiable information are kept in a secure environment.
